Mobile Computing - Increase Employee Efficiency, Productivity and Lawsuits

All this mobile computing technology coming fast on the horizon has a few disadvantages with employers. New employment law cases show that employers are liable for accidents while using such mobile technologies while driving or even while crossing the street and not paying attention.

This includes not only in the act of their daily work, but also during non-work periods when the employee is using the device but not on the clock. A recent law review research article;

"Mobile Technology and Employer Liability for Cell Phone Accidents" by Laurel A. Van Buskirk

Indicates that you as an employer may receive incredible productivity efficiency statistics by implementing such devices and allowing for a more robust mobile computing strategy, but you are also opening your company up for severe potential litigation in the event of an accident. The lawyers are going to take a good chunk of that new efficiency you have attained from you?

Is this fair that lawyers should be able to steal all this efficiency from your company, even though they do not work for it? Some say yes, because if your employee is using such a device that you bought and paid for then you are partly to blame for the accident, never mind if an employee is negligent in using the device.

Will this hurt sales of Blackberry, AT&T video conferencing phones, Apple's iPhone or Palm Foleo? Most industry analysts do not believe so, but you may wish to be up on all these issues if you are planning to completely mobilize your company's workforce.
